He also did not know the Sheichenost at the time and on this occasion heard his name for the first time. So he had the feeling that it was a provocation to the detriment of the SdP. For these reasons, and in view of the instructions of the head of the SdP at that time, in which the administrators had been repeatedly warned against provocateurs, and had been instructed to prevent anything that could endanger the SDP's stock, he had instructed the Kunz to file a complaint with the gendarmerie. He had not thought of the possibility that Sheikhenost could actually be a man in the German intelligence service, otherwise he would not have given the job of displaying. Nevertheless, since this case was rolled up in such a form after the arrival of the Sudtenland, he could not resist the impression that this had only been done for the purpose of putting it cold and eliminating it from public life. As regards the allegation that the accused was indirectly to blame for the arrest of the former V-man of the German news servant Adolf Bürger, the latter is based only on the statement of the Indicator Kraft himself, who, in his interrogation, stated that he had filed the complaint on his own initiative, but that this decision had been triggered in him because the accused in Sheikhenost had ordered the Kunz to reimburse him some time before. This responsibility of the scoreboard Kraft can be true, but it does not have to be. It is also possible that Kraft only wanted to weaken his own guilt with this responsibility. It can therefore not be determined with certainty whether the accused indirectly caused the complaint of the citizen by force. In the case of Sheikhenost, on the other hand, it must be assumed that Kunz's restitution of the advertisement was initiated by the accused, this is also not disputed by the defendant. The court-recognizing court had now to check and determine whether the accused acted culpably, i.e. whether he was aware of Scheichenost as a V-man of the German intelligence service when granting the order to Kunz to file the complaint with the gendarmerie. This question can only be assessed and answered if the political situation at that time and the political attitude of the accused are considered at the time and must therefore be denied.
