L1a As regards the matter itself, the following facts were established on the basis of the documents of the Secret State Council and after carrying out further inquiries: Erwin Alois Sch e c h e h e n o s t and Adolf B u r g e r were working as V-men for the secret State Police, Annaberg outpost in the year l935 and had to work in defence on behalf of the criminal secretary of the FPleischer. Among other things, they had the order at that time to meet more detailed findings about the maneuvers of the Czech Wehrmacht to be expected in the autumn of 1935 and to look for further employees to carry out this order. On 25 July 1993 Mr Edmund K u n z from Laucha near Kaaden, who had died in the meantime, asked him to cooperate. Since Kunz, as co-wisher of the espionage activities of the Sheikh's East, was afraid of punishment, he went to Kaaden the following days to ask the accused, who was then district head of the SdP, how he should behave in this matter. At this conversation, which took place before 8 o'clock in the morning in the archway of the entrance to the Meissner brewery, where plaster was employed, was aus. Hu-bert Kraft, a miner from Laucha Nr.l5 near Kaaden. After the case had been told to the accused, he instructed the Kunz to report the case to the gendarmerie. In connection with this, Kunz and Kraft drove to the Gendarmierestation in Klösterle, where even Kunz, in the presence of the force, filed the complaint to Sheikhenost. Some time later, the then V-man Adolf B e r - g e r a similar thing turned to Hubert K r a f t . For fear of being punished as co-wisher of the espionage activity of the citizen, Kraft filed a complaint against citizens at the Gendarmerie in Kaaden against citizens. On 5 September 1935, the Czech gendarmerie arrested Sheikhenost and citizens on suspicion of espionage in favour of the German Reich. On the same day at 5 a.m. 3o minutes, 4 gendarmes appeared in the defendant's home, ran a 2-hour house search and confiscated a photo app. After that, the accused had to go to Prague under gendarmerie escort, where he was taken to the police headquarters there. In the Spio-nagesacne Jcheichenost, he was interrogated for four hours and informed that the criminal proceedings would also be opened against him because he had not filed the complaint against Sheichenost. He escaped further prosecution only by believing that he knew the force "as a serious man and as one of the leading SdP members" in Laucha and was therefore convinced that his mission to report the matter to the gendarmerie was being carried out. At the same time, Kraft and Kunz were also in the police headquarters in Prague, where they were also heard about this matter. Then, the accused, as well as Kraft und Kunz, were released. Since the latter were without funds, the defendant paid them a meal and the return trip home in the "German House" in Prague. Adolf B en g e r was arrested on 26.6.1936 for espionage in favor of the German Reich and Wexschenraub to l2 years heavy Ard26819
