4Y The defendant Lang, too, with the help of his employer company, the Letov-Werke, and the Postex-GmbH, has supplied meat in the trade with Pospißil. However, his act lies in the autumn of 1940 and thus before the entry into force of the Kwvo in the Protectorate, it represents itself as an aid to the act committed by the managing directors of the Postex, which is punishable as a continued act according to § 1 Kvvo. According to § l5 a para.2 of the Vo on the exercise of criminal jurisdiction in the Protectorate of Böhnen and Moravia, as amended by the 2nd Supplementary Decree of 5.5.194l (RGBl.l p.248), however, German criminal law applies to all persons involved in an action punishable under German law. In the interests of a uniform legal assessment of the natural context, this provision extends the field of application of German criminal law to the parties without regard to whether or not they would otherwise be subject to German law. This is the case here. Therefore, the defendant Lang was also to be charged for aid to the war crimes, this consequence would only be rejected if his behaviour were otherwise impunityless. However, without the application of the Kwvo, he would also be punishable for aid to the infringement pursuant to § 9 of the Ordinance on Authorization of l8.9.1939.
