STATE SECRETARY FOR THE RUSSIAN PROTECTOR IN THINGS AND IN MORAVA, PRAGUE, inv. 1641, sig. 109-4/1396
English Translation
7 - 39 - Infringements of this provision constitute genuine criminal offences, according to the nature of their wrongful nature and the amount of the fines and fines imposed, as the Special Court has consistently denounced. To this extent, the Kwvo has not created a new criminal offence, but has only specified the existing criminal offence and extended it within the scope of criminal law. In such a case, the continuation relationship with the legally amended criminal acts exists. (cf.Kohlrausch, Erl.III to § 2 a STGB and EGST 68 p.338 and 71 p.92). An exception must be made in this respect only with regard to the complaint of Pospissil. He was dismissed on 1.2.1994l from his post as department head of the meat purchasing department and thus practically in April or May 1942, formally only on 2.7.1942, was remarried. The intervening period of more than a year, in which he was a purchaser of colonial textiles and foreign textiles, i.e. completely different and unrelated to the crimes of the other defendants, excludes from him the continuing link between his participation in the meat black-dressing action and the black slaughter action. His behaviour before 19.4.194l cannot therefore be covered by the Kwvo. On the other hand, he continued to act in the context of the black slaughter operation from the time of his re-care with the meat purchasing department until his arrest. The defendants Zitek, Capek, Vobsik, Novotny and Kettner, partly through mediation of trade opportunities and in the handling of the trades, partly by removal of the cattle and meat, or by the execution of the black slaughters and the hand-outs provided for this purpose, Zitek also supported the black-slaughter and black slaughter action of their employer in the knowledge of all the inconsistencies justifying the criminality without their own personal advantage and therefore supported the aid to the crimes committed by the board members and employees in accordance with §§ 1 para. One KWvo, 49 STGB guilty.
