bV -2- The approval under the proposed government regulation is not intended to replace the approval required under other regulations, e.g. the land reform laws. The approval authority is the district authority, but it is provided that the Ministry of Agriculture may reserve the authorisation for individual cases and for special types of cases. This is to be done in particular for large-scale property, but also for cases in which public authorities / protectorates, countries, districts, municipalities, institutions etc./ are involved in the legal process. It is assumed that Section IX is responsible within the Ministry of Agriculture. The decision of the district authority may be appealed to the regional authority in accordance with general regulations, unless it is excluded after the decree of the Reichsprotektor of l8.ll.194o' - I 1 a _ 6l30 - because the decision of a district authority sd s d det is final. The appeal to the Supreme Administrative Court is excluded in the draft, since a judicial review of decisions taken by administrative authorities at the direction of douch services is undesirable.
