The experience gained with the application of the laws of the Protectorate of Bohemia and Moravia on land transport /: Government Regulation No. 218 and 313/38, extended by Reg. No. 80/40 and Reg. 461/40:/ have shown that they are not sufficient to safeguard German interests in rural land transport. In particular, the provisions contain gaps in the sense that property contracts between relatives are free of permit, since, in the case of succession, there is no possibility of interference at all. The proposed draft government decree, based on the Real Estate Traffic Notice of the Reich dated 26.1.1937 Rg.B1.I p.35, closes the existing gaps. The contracts between close relatives with the exception of the sale contracts, which are also subject to approval in the Reich, remain free of authorization. Furthermore, the succession between close relatives remains free of approval. Of course, even such contracts do not require approval in which the German Reich is involved /cf. § 4 of the draft. The approval can be refused according to § 6 of the proposal for reasons of public interest. The version of this paragraph agrees with the version of § 6 in Reg.V0. 218/38. The reasons for refusal mentioned in the Land Traffic Notice of the Reich in detail are not taken over, since the ground policy objectives of the Land Transport Notice are not decisive here. Therefore, the German interests best correspond to the broadest possible formulation of the grounds for refusal. -2-
