44 Annex 2 Ordinance supplementing the War Economy Vo of 25 March 1942 (RGB1. I p.147). Article I § 1 of the Code of Civil Procedure of 4 September 1939 (Reichsgesetzbl. I, p.16o9) is replaced by the following: §1 (1) Anyone who destroys, removes or withholds raw materials or materials belonging to the vital dedarf of the population and thereby maliciously endangers the coverage of these needs will be punished with prison or prison. In particularly serious cases, death penalty can be recognized. (2) The same penalty shall apply to those who remove certificates of entitlement or forms for this purpose, place them on the market or obtain copies of certificates or forms. (3) If the perpetrator has acted with the intention of enriching himself, the penalty shall be recognised in addition to the penalty laid down in paragraph 1 or paragraph 2 on fines. The amount of the penalty is unlimited, it must be attributed to what the perpetrator receives for the act and exceeds the profit he has drawn from the act. Instead of the fine, it can be recognized on asset identification.
