To the Lord Reichsprotektor in Bohemia and Moravia in Prague Betr.: Organisation of the City of Prague (introduction of the administration under the supervision of the Oberlandrat). Reference: Decree of 14 March 194o - No. I 2 a - 12o5 -. On the questions raised I take the following position: I. Organizational and administrative side: 1. The provision of § 6, para. 3 of the Construction Ordinance of 1 September 1939 confers on the Oberlandrat the supervision of the protectorate authorities of its area of office. The Reichsvorzeichnung makes no distinction between the Protectorate authorities depending on the size or meaning; it rather subordinates all the authorities in its stage to the appearance of the Oberlandsrat. Pür the city of Prague is clarified by the fact that it is under the responsibility of the competent Oberlandrat in its own sphere of activity, like any other municipality, in the transferred sphere of operation, like every district authority, whose department in the sector of Czech administration has its counter-pol. The removal of the city of Prague from the previous administrative structure (with the corresponding amendment of the building regulation) would therefore, without the creation of an intermediate instance, lead, on the one hand, to the transition of the supervisory functions and administrative activities from the Oberlandrat to the Ant of the Reichsprotektor, and on the other hand, inevitably to the transfer of the responsibilities of the Landesamt to the ministries. It would be essential that the city of Prague Inud0 be directly under the authority of the Reich Protector, as the representative of the Führer and Reich Chancellor in the Protectorate and as the commissioner of the government of the Empire, (response from l6.3.1939, Art.5, Abs.2) directly of the last and highest instance.
