23a permanent retirement according to § 2 para. 1, point c of Reg. Vdg.Slg. No. 397/4l. At the same time, the Gheime State Police must be informed of this measure, with the request to provide any material which would justify a more serious criminal action. In this way, a considerable part of the pending cases will be dealt with by civil service until further notice, but this will not affect the provisions previously laid down on the public servants detained on 1.9.1939. 2./ If an indictment is required against an arrested official or if the criminal proceedings are likely to be carried out, criminal proceedings shall be pending until the criminal procedure has been concluded. 3./ In cases where civil servants have been recognised by a standing court sentence for referral to the secret state police and have been requested by the commander of the security police to carry out the dismissal on the basis of Reg.Vdg. 397/4l, I ask that the service be released if the detention has lasted more than 6 months since the court ruling. If release from prison has taken place earlier, other measures are required on the basis of the provisions of Law No. 397/4l /e.g. transfer or retirement/. The relief measures provided for in the letter to the Ministry of the Interior, as reproduced in the above copy, do not apply to such cases.
