According to Article 10 of the "agreement between the German and Italian governments on the distribution of supply facilities for the benefit of the people of Germany and the German Reichs- länder, which migrated to Germany, of 22 December 1939", the provisions on the pensions of the former Südbahngesellschaft, which were laid down in Article 17 of the Nom Convention on the Southern Railways of 29 December 1939, are amended as follows: In the meantime, Jtalien will continue to pay the pensions of those entitled to benefits even after their emigration to Germany. This also applies to those old-time pensioners of the Südbahn who have received their remuneration from Jtalien until now, but who have already had their residence in Germany and who have either already been members of the German Neichs or who have been a German national only on the basis of the agreement on the economic implementation of the resettlement of Volksdeutschen and German Neiks members from Jalien into the Deutsche Neich of 21 January 1971. In the first instance, a reasonableproportion must be paid in the amount of the approximate difference between the pensions paid by Jtalien and those which would be paid to them as old-time employees of the Südbahn under the former Austrian law. The documents required for the comparison (pension decree, pension book, etc.) must be required by the pensioner himself for the time being. Whereas account should be taken of the regulations and decrees on amendments to the Austrian pension legislation which have been issued since the Sstmark was joined; whereas the period of service which Jtalien used for the calculation of the pension is provisional and the local class B (or 90%) should be used as a retirement period; The pensions thus determined are subject to taxation under Neichrecht.
