t0r 197 The Reichsverkehrsminister 52.514 Par/Südtirol Berlin, 6 February 1940 Takeover of German railway workers from Güdtiroll I. A. Allgemeines The return of the people's Germans living in South Tyrol to the Reich, which is carried out on the basis of the German-Italian agreement of 21 October 1939, becomes such people. German officials who have been employed in a public service in Jtalien, and the beneficiaries whose pension rights are based on a public-service relationship are also transferred to the care of the Reich. The distribution of the pension costs and the provisional payment of the pensions by the former Italian services were governed by an agreement of 22 December 1939 between the two negations. October 1939 HSB4364/39I/II III SB 5526/39 6839 —, of 9 December 1939 and of 17 January 1940 6839 II SB 43/40 — are then eligible for the takeover of the People's Germans, 6839 who have made the binding declaration to their home municipality that they want to acquire the German Reich and move to the German Empire. The public servants who made this declaration could not remain in the Italian service beyond 31 December 1939. However, it was ensured that they would be paid their remuneration in the amount up to the present amount, at the expense of the German Reich, by 30 June at the latest. However, until 31 March 1940, staff who reside in the premises of the administration which are indispensable for the service must dispose of these apartments. Accommodation The provisional system for the payment of remuneration shows that it is in the interests of both the migrating Beams and the Deutsche Reichsbahn that the eligible staff will be taken over with the greatest acceleration. It is important that the staff to be taken over treats well and that their wishes be considered as possible in their accommodation. Persons In order to be taken over into the Reichsbahndienst as civil servants or workers, the basic principles of this decree apply: 1. Employees who have already been employed in the Italian state railway service and who have left the service due to the submission of their declaration of option for the German Reichsbehörde as of 1 January 1940. A part of them has been employed in its home area, but the greater part has been in the old Italian provinces. 2. Pensioners of the Jtalienische Staatsbahnen or the former Südbahn-Gesellschaft, who have not yet reached the age of 60, want to be converted. 3. Staff who have already faltered in the Italian state railway service or in the service of legal predecessors and who have been dismissed prematurely without entitlement to pension even if they have had a different occupation in the meantime. 4. Staff of Italian private, small, cable and suspended railways, but not of trams. 5. Staff of official and private nesting offices. 14*
