4a In this situation, most parachute jumpers and agents of Czech ethnicity should be regarded as members of the Protectorate. The entry of the protectorate members into foreign military services alone does not entail the loss of protectorate membership. 1S19O 2) Parachute jumpers and agents, even if they have not come to the execution of their orders, are criminally liable to be prosecuted because of state treason (enemy benefit according to § 91 b RStGB., possibly also espionage pursuant to §§ 89, 90 RSt GB.), etc. also because of high treachery (§§ 80 para.1, 82, 83 RStgesetz.) regardless of whether they are foreigners or protectorate members (cf. Article 4 (1) and (3) (2) of the RStGB, as amended by the V0. of 6.5.1940 - RGBl. I p. 754). Only prosecution on the grounds of treasonous weapons aid (§ 9l a RSt GB.) presupposes that the German national or protectorate member is the latter.
