142 3 of the duration of two years are not transported". For the definition of the term "promotion", §§ 17 and 32 of the Ges. Coll. No. 103/26 are valid for the given legal condition and such promotion can only take place by the award of a systemized post of the higher grade. However, such a decision did not occur in this case. At the meeting on 7 October 1 940, I drew the attention of the city council to the ban on transport and the town council rejected Bernhard Hofmann's request for transport. By order of 2 December 1 9 40, the city board approved the request of the police officer to allow Bernhard Hofman for examination of police lines. However, with the given legal status, I could not imagine that something illegal could be seen in this decision, especially if this happened before the decree of the Reich Protector was issued and I know well that the ratio legis of §3 of the regulation [No. 379/38] is of a material nature, i.e. savings in personnel expenditure should be achieved. In the seat of the city councils of 6 January 1994l, I repeatedly drew attention to § 3 of the Ordinance Coll. No. 379/38 on the ban on transport. When, however, I was told that in this case it was not a promotion, but the granting of a mere title, I do not know - even today, how I should have resisted the request of the police department, if as a support only the cited §§ l7 and 32 of the Ges. [l03/26], according to which it was not possible to see any "carriage" in the requested decision, even if it had been interpreted strictly.
