To your attribution of October 1 4th, 1994l, with which you have a compensation in amount of 3,340 RM from the former government commissioner of the city of Brüx JUDr. Adalbert Pfleger, who is the head of the political administration in Königgrätz, states the following: In the given case, the government commissioner appointed with the leadership of the municipal affairs has not as a pri vate officer, but as a public officer for the exercise of his function in accordance with § 66 of the local order in Bohemia of the Geneinde, in respect of the transferred sphere of activity also of the government / Art. XIII of the Law of 5 March 19862, Reichsgesetzblatt No. 18/ Verantwortliches Gemeindeorgan decided. According to the negotiating acts it is proved that you were a contract and by no means a public servant employed by the Land.Ges.No. 35/lgo8 in the version of the Ges.Slg. No. 443/lgl9, which also by the final decision of the Landesbehörde in Prague of 6.1l.l935 Z. 6ll6 ai 1935-Abt.2 was established; therefore, only a labour court according to § 1 of Ges. Coll. No. l3l/lg3l and no administrative authority could decide on disputes arising from the service relationship between you and the municipality. Only then, if the municipality were in dispute with you, could it assert its claim for damages against the government commissioner, if he had acted unlawfully and against the current regulations and thus caused damage to the municipality.Exp.
