By the judgment of the Eger criminal chamber in July 194l in Karlovy Vary I was sentenced to a 2 1/2 year prison sentence and to two years of honor for commercial fruit abortion, committed in the period from l935 to Sptember l937, sentenced. The judgment, which can only be explained by the creation of a deterrent example, has made me and my family extremely difficult. However, as I know, I feel that it is too hard for me, and with me, as far as I am aware, to be a wrong, at least in terms of the extent of his sentence, and it is in my distressing and promising, that a request of grace, which is currently ongoing after the opinion of all the authorities, such as the State and Gau Health Office, the party offices of the Karlovy Vary district, the Gaues district and the Reich and the Chamber of Penalties in Eger, all of which have spoken out for pardon in view of the special circumstances, should be dealt with in an initial manner. All the more devastating for me is now a decision by the SS Hauptamt in Berlin, according to which I was declared an enemy of the state and my entire fortune was confiscated, and which also provides for me to be subject to the Gestapo after the convocation of my judicial powers. Now that I am not aware that I have ever committed an anti-state act as a citizen, let alone as a stateburger of the third Reich, the assumption is that false or inadequate representations of a person who has not been trained in this medical discipline have led to a false assessment of the situation at the SS Hauptamt. I would therefore kindly ask you to take note of my explanations below, which can be checked for their accuracy at any time. If, in my plight, my sentence of imprisonment in the prison of the Landgericht in Eger directly turns to your Excellency, it is because you appear to me as a symbol of rigour and justice at the same time and I do not ask for mercy, but for strict and just judgment. After many years of clinical training, I settled in Karlovy Vary in the year l933 as a specialist doctor and worked as such until my arrest at 3l.Jänner l94l as a chief physician of the women's and gable department of the general public hospital in Karlvary. That I created here the bear department and the birth rate of approx. Loo per year up to 7oo in the year l939, whereby the number of abortus cases fell from approx. l5o to approx. 3o, is only mentioned by the side. Just as in the Old Kingdom up to l933, so in Austria and Czechoslovakia the attitude to the question of abortion was a much laxere. Thus it is known to all the authorities working in this area that a large part of the doctors in Czechoslovakia and in Austria have performed the interruption of pregnancy with the approval of the authorities not only for medical reasons, but also for economic and social reasons. As a German, I have already put myself one year before the conclusion, without prejudice to the attitude of other colleagues on the question of pregnancy interruption, completely on the basis of the rich German requirements.
