Judicial Division Prague, 19 October 1943 II 100/43 g 59 Subject: Draft letter to the GbV. I note the following with regard to the proposed draft: I. In fundamental respects If the GbV is approached with a detailed description of the local circumstances, then this is the reason for the droning recognition of the competence of the GBV in respect of the confiscation system to be set up by the German authorities in the Protectorate. The GbV, however, has already been active in this respect; only so far we have not had any correspondence with it, however. I would also like to thank the rapporteur for his excellent report. Since the Wehrmacht authority, as the last confiscation action has proved, has only the function of a military inspection - which strictly carries out the Berlin order - since replacement inspection, it is obvious to contact the GbV precautionarily as the place which the OEw regards as decisive also for the protectorate. The explicit recognition of the competence of the Gbv does not in itself mean a reduction in our position, since the GBV will act in the same way for the Berlin Supreme Court in the O.tN Reich authorities. After all, it must be seriously considered whether it is not to be taken directly with the OKw Pühlung, whereby the cnd tlse GbV could be notified by a copy. Similarly, other Supreme Reich authorities (Sauckel, Thierack) have also applied to the OKW and have achieved special protection under the general jurisdiction of the GbV. MP
