Thus the external and internal preconditions of the fraud are fulfilled in the sense of § 263 StGB. The defendant Novak acted in the intention to obtain a contributional source of income for himself in order to be able to continue her usual life as a great lady even after the disappearance of her so far enduring lovers. In carrying out this overall plan, she has always misled and exploited her victims in the same way. Therefore, apart from the unity of her intention, which includes the overall success, there is also similarity of the action directed against the same legal property in all individual cases. She is therefore guilty of continuing fraud.When she committed the crime, she acted to a very unusual extent maliciously and, through her conduct, also significantly harmed the welfare of the people:
