The Court of Justice of the European Communities, the Court of First Instance and the Courtof Justice ofthe European Communities have held that, in the event of a failure to fulfil its obligations under Article 85(1) of the Treaty, Article 85(2) of the EC Treaty is to be interpreted as meaning that, where a Member State has failed to fulfil the obligations laid down in Article 85(3) of the EEC Treaty, it is necessary to provide that the provisions of Article 85 of the ECSC Treaty are to be complied with in the light of Articles 85 and 86 of the EAEC Treaty.
