If the child's own current net income exceeds the upper limit only insignificantly, family maintenance entitlement may be recognised in spite of the fact that it is necessary for reasons of uniform treatment of several serving children belonging to the household community or to avoid hardship. (b) Any children whose family maintenance entitlement is to be denied in accordance with (a) shall not be included in the calculation of the needs of the family maintenance (Section II, paragraph 1 (3) and paragraph 3 (1)). (c) The general rules for the examination of the conditions of the family pension to be met in respect of the requirements laid down in Sections 2 II, 2 and 6 (cf. Section II). (a) to be applied mutatis mutandis to children living outside the household of the parents (§ 2 I EFUG), (b) to those living outside of the household in § 2 II No. 2 and 6 EFUG. and in point l3(b) of the Circular of 5 May 1942, members of the conscripts who do not live in a family (household) community with other dependants of the family dependant, soferò do not require special conditions to raise the upper limit (paragraph 1 (5)(a), sentence 1).
