The circular issued by the Reich Minister of the Interior on 25 January 1940 in the Reichsmin.Bl.No.5/l940 emphasizes that the OKW generally abolishes the restrictions of § 5 d.R.L.G. on the basis of § 4, 2, sentence 1 of the same law, but not in favour of all the requirements of the Wehrmacht, such as only for the benefit of the military administration, the naval itendanturen, etc. In addition, the OKW, in agreement with aem GBV. and the GBW., has authorised the Wehrkreisverwaltungen, the restrictions of §5 and 6 d.R.L.G. on the basis of § 4, Abs.2, sentence 2 R.LG. in individual cases for the use of establishments in the catering and accommodation industry, temporarily, at the latest for the duration of the war, to lift the necessary places outside the Wehrmacht. Before the use of buildings without the restrictions provided for in § 5 can be carried out by a place of demand outside the Wehrmacht, a corresponding resolution of the competent Wehrkreisverwaltung, in this case the Wehrenmacht authorised representative at the Reichsprotektor, must be issued.
