The Court of Justice of the Federal Republic of Germany, the Court of First Instance of the European Communities, has held that, in the event of a failure to fulfil its obligations under Article 85 of the EEC Treaty, it has failed to fulfil the obligations conferred on it by Article 85(3) of the Treaty, the Commission has failed in its action to fulfil obligations under Articles 85 and 86 of the EC Treaty in respect of the application of Article 85(1) of the ECSC Treaty.
