It must rather be assumed that the 3 O00.- RM found in his desk is the remainder of the total of the 53.547.25 RM obtained from the acquisition, but of which 31.900 RM were to be held in the special account, Ilsenau and I0 O00 RM Lieutenant G r e i w e. With regard to the diversion of these 4l.900.- RM, Major J u r k is likely to have been guilty of embezzlement, for the rest there is an urgent suspicion that they have been suppressed. An embedded position is also likely to be present with respect to the approximately 4 500.- rm used for camaraderie purposes. With regard to the embezzlement, there should even be qualified concealment, underlining in accordance with § 350 and 35l, as Major J u r k has suppressed the issue of delivery notes and other supporting documents. For the unauthorised supply of goods and articles from stocks of the Einsatz Staff II, essentially the same stock remained, as it was already laid down in the interim report of 8.4.944. It must be stated here that according to the information provided by the District Superintendent Master B a n s c h e n b a c h, some of which are confirmed by the statements of Lieutenant T a r g a t s c H and Officer A s s s m a n n, in order to disguise the unauthorized surrender of the items, Major J u r k has given the order to destroy invoices in the total amount of approximately 40 O00.- RM and not to accept this invoice amount in the balance sheet as a debitor item, but as a stock. In addition, it is further established that H a n i s c h has also bought a Gobelin. Essentially, the recipient will be included in the anonymous delivery note books that have been secured. The investigation of these buyers is no longer possible, since their name does not appear in the booking documents or in stock lists. The amount of these purchases can only be determined approximately if the amount of invoices intended for destruction and the anonymous delivery notes are taken into account. In detail, names of the persons who have been delivered preferentially are given in the Twiwchenbericht. In this context, the sale of 18 carpets and several leather suitcases was found to be a new occurrence in 1943. The delivery note on the carpets could be ensured. According to the lieutenant T a r g a t s c h, these carpets were given to the adjutant of the General Superior D a 1 u e g e. It is said that 4-Mainsturmführer K u g e r, 4-SturmbannführER K 1 u c k h o h n and 4-Obersturmfahrer B a r s i k o w have bought. A review of the journal, which was conducted during the sales period, which at that time was still led by the inspector G e r k e with the name of the buyer, showed that these names did not appear in the questionable time. Even according to these documents the whereabouts of these carpets cannot be determined. A clarification can be obtained by questioning the named ones. Major J u r k could not give any relevant information on this capi- tal. Major Y u rk has after Gross-Latein delivered another record player with speaker system, which is not yet paid. According to the author, this delivery follows without issuing a delivery note. Furthermore, Major J u r k has a film screening apparatus in his apartment, the collection of which is not booked and which has not yet been paid. ./.
