4 group Porst Prague, 19 September 1942. II/3 - K 158/42. Mr. Eing.: 22. SEP 1942 Ministerial Councillor Dr. G i e s, Czernin-Palais. Mr. Betr.: Request of Ludwig M ü 1 l e r. Reference: the letter of 12.9.1942 - St. S. XI B - l19 i/4l. I cannot support the renewed request of Louis M Ü 1 l a r. The right to the admission of the Sudeten course and payment of the price difference is in no way justified in any way. From the file material available here it can be seen that Lud-wig Müller also had no legal right to pay the pension. However, since the Secretary of State had made the request for clarification to the Protectorate Government, a formal legal basis had to be created. Therefore, at my request, the President granted the miller an allowance for his rest. Accordingly, it is not a demand that existed already in the year l938 and for which the creditor could have claimed the settlement of the price of Sudeten at the competent authority in the Reich, but rather a pording, which arose only with the granting of the grace allowance by the President. If the case could have been settled in the restitution provisions, Müller might have been able to deduce a right to price compensation. However, this reparation would not have been the responsibility of the Protectorate, but of the Reich, as Müller séinen resides in the Sudetengau and the decree of the l.lo. In 1940, only victims who have their place of residence in the Protectorate were granted the grace from here at the request of the Lord's Secretary of State and are transferred from here to the Sudetengau. Since this is an act of grace, no recognition of St. F1B-248a/42 can be obtained from the retroactive recognition from l93o onwards.
