Copy. Prague, 28 February 1940. With 1 annex forwarded to the Under-State Secretary on the instructions of the Secretary of State. Mr. State Secretary stands on the position that the Protectorate is for and for all time to make clear that members of the Protectorates and members of Czech nationalities are not and may not be hereditary farmers within the meaning of the Reichserbhofgesetz. The Frege was important because in the territories of the Eastern Mark, which had belonged to the Czechoslovak Republic, Tei- le von Erbhöfen, who heard the members of the Czech people, would be transferred to the territory of the Protectorate. In these circumstances, it is appropriate to draw the attention of Mr Reichsnährungsminister to the difficulties and, in addition, to reiterate the principle in the letter in question that members of the protectorate and members of Czech nationalities in the Protectorate are not, and could not be, hereditary farmers. The Secretary of State fears that the question of the introduction of the Reichserbhof Act in the Protectorate will soon be addressed again.
