A bse hrift Kanzlei des Führers der NSDAP. Hauptamt für Gnachensachen Berlin W 8 Voßstraße 4. 3 June 1943 Haupt- An den 396/43 Herrn Reichsminister der Judiciary III 1 - 397/43 398/43 B e r l in V B Dr. Ps./lh.- Wilhelmstraße 65 Subject: Gnagensachen Iudwig M a r t i n e k , Irag II, TIR and Rudolf B r o n d e r , Frag. In the appendix I send two applications for grace, a booklet of grace and two volumes of criminal acts as well as a copy of the position of Gauleitung Sudetenland of the lSDAP. of March l943. By judgment of the special court at the German Landgericht in Prague of 13 March July 1942 - 5 KLs 197/42 - 1132 - became Ludwig H a r t i n e k for aid to the crime according to § 1 paragraph 1 Kwvo. and for offense according § 1 sec. 1 Kvo, one year and six months prison and three year loss of honor, Karl L u c k for offense under § 1 subsection 1 Kvvo. and sentenced to two years and six months of imprisonment and three years of loss of honour for a year and three months in prison and RudolflfAdef for aid to the crime according to § l paragraph 1 KWvo. and for offense according to§ l Rbsatz l KWVo. In Martinek and Bronder, two months of detention each were counted on the recognized prison sentence, one month and four weeks with Karl Luck. In accordance with the case officer for mercy matters at the Gauleitung Sudetenland of the NSDAP. I did not find any special reason to strongly advocate for the approval of Gna- denden. The misconduct of the three convicts is all the more reprehensible as the perpetrators would have been obliged to be exemplary in their attitude and conduct with regard to their position as civil servants at the Reichsprotector of Bohemia and Kähren. Therefore, the recognized penalties do not seem excessive to me. In the present situation, it would also in itself be necessary to ensure the full enforcement of the recognized phereits-criminals.
