However, if the information provided by the injured party is taken as a basis for the assessment, the sentence appears to be relatively mild; on the other hand, the content of the file shows that the injury occurred after a visit to the inn and at any rate the companion of the black witness H u m l was drunk. There are no definite indications that the attack on Schwarz has taken place because of its status as a member of the SS. Consequently, there is no objection to the refusal of the defendant to refer the case to a German court (see § 15 para.2 of the V0 of 14.4.1939). It does not seem appropriate to object to the judgment of the Protectorate Court, since this means should only be used if the case has a corresponding meaning - especially in political terms - but this is hardly the case in the present case. It is therefore appropriate to leave it in the judgment of the Protectorate Court. lelto may be asked to return the files after noticing and notifying whether protective detention has been imposed on Hájek.
