The ideological attitude underlying these efforts has overwhelmed National Socialism. The National Socialist people's order does not build on a no longer existing contrast between the state and individuals subject to domination, but rests on the new reality of the community and leadership. The state as the administrative organization set up by the leadership for the purposes of the people's community and the individual people as a member of the community and a follower of the leader are thus directed towards the same goal. There are, legally recognized, neither state nor individual interests, which could be different from the national interests. The former function of police law, which clearly separates the state from the individual sphere of interest, has therefore lost its meaning. In its measures, the police do not "against" the individual, as the individual who calls for a police order can act as a "counter-player" of the state. Therefore, there is no room for a real dispute between the two, which would require a neutral third party to take a decision. It can only always be a review of a measure taken to determine whether it constitutes the correct and appropriate execution of the order given to the police by the leadership. A procedure such as the previous administrative dispute procedure, designed to paralyze the police in their activity, is unsuitable for such an examination, because it benefits the elements to be combated by the police and thus makes it more difficult to carry out the police tasks, the independent judge, who is exempted from the service order, has lost his sense precisely here, because he has to endanger the uniform use of the police, outside the sphere of influence of the leadership of the Police. On the other hand, it has also become largely unnecessary. The police administration is today unequal in examining the correctness and expediency of a measure.
