On the other hand, the proposal for the new establishment plan contains only 2735 civil servants entitled to a pension. Therefore, a significant number of employees who have previously been entitled to retirement will have to be transferred to employees' and employees' posts. In the event of a transfer of a staff member from a retirement office to an employee or worker's office, the city shall be required, under the existing law, to pay amounts to be calculated on a case-by-case basis from its premium reserve to the General Pension Institution or to the Central Insurance Institution for the establishment of a lawyer's pension. This provision has undoubtedly been adopted in cases where a staff member withdraws from the city administration and transfers to private services; it is questionable whether this procedure is applicable to the massive transformation of employment relationships in the context of the implementation of the new establishment plan. In any event, the benefits of the social insurance institutions would be considerably lower than the pensions which the staff members would have to pay in order to maintain their pension entitlement from the city. In addition, the pensionable staff would be 8 % from the date on which they were transferred to their place of employment until their retirement. The loss of pension rights would therefore be particularly severe for older staff with a longer period of service. For this reason it should be considered whether it is not intended to determine that workers with a certain total period of service in public bodies will be entitled to the city's pension when the new establishment plan is implemented from a retirement or worker's place of employment and that the insurance obligation at the pension or insurance institution ceases to apply.
