The relevant considerations were reflected in the provision of No. l7, paragraph 1 of the Decree on the introduction of public welfare for Germans in the Protectorate v.4.3.40, I 2 b - 4000, that this decree was not declared to be valid for Jews. Hereby it had been assumed that an obligation to promote Jews in need of assistance, insofar as the legal conditions are met, already exists in accordance with the Home Law Act in force in the Protectorate and should not be affected by the welfare decree v.4.3.40. The view of the Ministry of the Interior that the provisions of the Home law law law of RGBl. No.l05/l863 the community's obligation to provide for its Jewish residents in case of need of assistance, has not been changed, this is in accordance with the aforementioned mandatory legislation.
