In both cases Dr. Tree strictly refused the interruption and explained to both women about their repeated urge and questions that they would not find a doctor in Germany who would do this. In response to the question of women, whether it is not known abroad that there is a possibility of interruption of pregnancy if a second doctor is indicated in Czechoslovakia. At the further request of the women to inform them of the address of a doctor in Czechoslovakia, the defendant referred to Dr. Baum was the name of Dr. Kafka, a well-known physician in Karlovy Vary. The defendant, Jude Dr. Baum, knew the Jew of his former spa stays in Karlkovy Varies and has had close friendly relations with him since then, which also led to an exchange of views on specialist medical questions, including the interruptions of pregnancy. Kafka has been doing pregnancy interruptions for years for remuneration. Furthermore, the admission of the accused Dr. Kafca and Dr. Baum has proved that they had agreed that if Dr.baum had a patient to interrupt the pregnancy, he would be particularly pleased that he could send this patient to the Dr.Kafka for treatment. They used a special way of expressing themselves by borrowed words and numbers from the "gulf language " in their correspondence, whereby Dr. Baum gave Dr. Kafka a hint as to what amount the defendant could demand from Dr. Cafka for her work. The defendant, Dr. Baum, gave the name of Dr. Kafka at her repeated insistence on the fact that, after two searches, he determined a pregnancy.
