Nr.: 3255 173 State Secretary d.d. 616 To the letter of Dr.Eduard Graf von W e s t p h a h l e n dated 22 April 1994 concerning the transfer of his lecturer from Vienna to Prague, I would like to note the following: Westphalen is known to me from Vienna, he did not manage to establish a reputation as a scientist in Vienna. He has so far published only two scientific papers. At the original request of the Westphalen of Sept 1939, the Dean of the Faculty of Law of the University of Vienna appointed Prof. Schönbauer commented on 19.10.1939 that, on the basis of the expert opinion of the professors Verdross and Hold-Ferneck, the Faculty of Economics and Humanities is favourable to the aspirations of the Westphalen and that the Dean therefore advocates the granting of the teaching authority at the Prague University. This was probably done out of the desire to get rid of Westphallen. The expert opinion of the pro-fessors Verdross and Hold-Ferneck is summarized at Sehluß there, "that Westphalen is a gifted and knowledgeable young scholar, who shows a great deal of understanding for the new German state law and its problems. It can therefore be expected that Westphalen could still do valuable work in the field of state law if he, who had previously been very busy in a practical profession, would find the necessary time for scientific work in a scientific position." The rector of the Deutsehen Karls-Universität refused, with screams of 18.1.l940, an endorsement of the change of the university from Vienna to Prague on the following grounds: "As can be seen from the thoroughly greened report of the lecturer Raschhofer, the basic attitude of the teacher Dr. Westphalen in such a way that there is a danger that the university would be drawn into disputes through its activities, which would be harmful to its D especially in the period of reconstruction." After reviewing the work "The problem of fundamental rights in the constitutional life of Europe", lecturer Dr. Raschhofer concluded: "The work is an expression of a Catholic state view.
