Since the Czecho-Slovak state has ceased to exist, the Protectorate is not identical with it, the members of the Czechoslovak State are to be regarded in German opinion as "stateless". If they have fought against the Reich, then criminal prosecution for treason or other offences cannot take place. III. Almost all the authorities sent are Slovaks. Even though Slovakia enjoys the military protection of the Reich, it is an independent state which is new in the present war. Its nationals cannot commit treason against Germany by participating in the struggle. The extent to which they have committed criminal offences under Slovak law is subject to the review of the Slovak courts. IV. In the case of Barto, it is likely that it is a techecho-Slovak State which has neither acquired the German nor the nationality of Xosprotektorat.
