It seems necessary in this context to briefly present some fundamental considerations. Hermann Göring-Werke are at the moment operating manager of Witcowitz after the transfer agreement. According to the current legal situation, decisive factors in Witkowitz are: 1.) The Director General, who is at the same time the only trade union board (Kuchinka), 2.) Hermann Göring-Werke as the manager of the works according to the works contract, 3.) the administrator with the advisory board after the decree of the Reich Commissioner for the treatment of hostile assets of 26.6.1943, who has the powers to be assigned to the trade day and the supervisory board, 4.) the representative of the German State Ministry on the advisory council performs a special function, which has to monitor the compliance with the conditions which Hermann Göring-Worke took over before the approval of the business contract. In the event that Guido Schmidt is to become the administrator and trade union board, the influence would be as follows: a) Managers, administrators and trade unions are then Hermann Göring-Werke. b) The Director General (one who would) will have the position of executive without being able to influence the decisive decisions. (c) The representative of the Minister of State would practically no longer be available to the Forum of the Advisory Council; the implementation of the special aspects of the State Secretary would therefore be of considerable importance. This implies that, with a consistent continuation of the previous general view, there is a need to ensure that 1.) either that the administrator is called to be a personal assistant of this space, or at least that of a person whose attitude and attitude guarantee an objective conduct of the business, or 20267 2.)
