First of all, the following guidelines must be followed: I In the occupied territories, the death penalty is based on crimes committed by non-German civilians who are directed against the Reich or the occupying power and whose security or battalion is carried out. In principle, the offences of Section I shall only be condemned in the occupied territories if it is probable that the perpetrators, at least the main perpetators, will be sentenced to death, and if the proceedings and the execution of the death sentences can be carried out as quickly as possible. Otherwise, the perps, at the very least the principal perpetors, must be brought to Germany. III. Perpetrators who are brought to Germany are only subject to the war trial there if special military concerns demand it. Germans and foreign services have to be explained on questions about such perpetrator, they have been arrested, the state of the proceedings does not allow any further communications. IV. The commanders in the Occupied Territories and the magistrates shall be personally responsible, within their jurisdiction, for the implementation of this decree. V. The head of the High Command of the Wehrmacht shall determine in which occupied territories this decree is to be applied.
