To the letters of 17 and 21 September 1943. d T I believe it is essential to make a more detailed regulation because of the eviction of the right of grace by the Reichsprotector, as is also provided for in the order of the Führer concerning the Protectorate of 20 August 1943 under I sec. 2 no. 3, this regulation should, in my opinion, be made by an order of a Führers and have approximately the following content 1. The Reichsprotektor exercises the grace and repression unjustly in all criminal cases which belong to the jurisdiction of the German courts in the Proteltorat. 2. In criminal matters, which fall within the jurisdiction of the Volksgerichtshof or the Oberlandesgerichte in Ireslau, Dresden and Ieitmeritz, and which concern the interests of the Protectorate, the mercy and repression is exercised unjustly as follows: a) By the Reich Protector in agreement with the Reich Minister of Justice, when the crimes are committed in the Protectorates. b) By the Minister of the Reich of Justice in agreement with the Reich Protector, if the crimes are committed outside the Protectorate, provided that these crimes or the sight of the perpetrators have political significance for the Protectorates. (e) From the Führer, if the understanding required under (a) and (b) between the Reich Protector and the Reich Minister of Justice cannot be achieved, and in all individual cases in which:
