In the case of non-members of the European Community, the Court of Justice has held that, in the event of a failure to comply with the provisions of the Treaty, the Member States must, in accordance with the procedure laid down in the Treaty establishing the European Atomic Energy Community, take the necessary measures to ensure that the Member State concerned is able to fulfil its obligations under the Treaty.
