24a 6 At the entrance examination, the current level of knowledge of German will be less decisive than the general level of talent and achievement of the child. In this last respect, the entrance exam must be strictly handled. If it is not passed, the child must be assigned to a German primary or secondary school and assigned there, depending on the situation of the case, to a special department or also to a directly German class. Special departments to the first classes of the German secondary schools can be formed, if this seems necessary. They must be approved by the German Landesschulrat. In the case of admission from a Czech citizen's school or a Czech higher school to the 2nd grade of a German higher school, it is particularly important to examine carefully whether the level of talent and performance of the school is relevant. In fact, in addition to the efforts to master the German language, children are sufficient to obtain one year of foreign-language instruction. Depending on the situation of the case, the child can be assigned to the first class of the German high school or the German secondary school if it cannot be admitted to the second class. German higher schools must be established only in exceptional cases. Authorization is granted after careful examination by the German State School Council. The transition from a Czech citizen school or a Czech higher school to the 3rd or even higher class of a German higher school can only be considered in very special cases. They require the approval of the German State School Council. In doing so, the German state school councils and the heads of German higher schools are made an urgent obligation to maintain the performance of German upper secondary schools as selection schools under all circumstances. Parents whose children cannot be admitted to a German higher school from this point of view should be advised in such a way that the children do not return to the Czech school they have attended so far, but to a main school in Germany.
